Terms of Sale:
1. The tender is open until 29.09.2025.
2. At the conclusion of the tender, the vehicle will be sold to the highest bidder.
3. A purchase contract will be entered into with the bidder who submits the highest offer, subject to approval by the creditors' committee and the insolvency administrator. The subject of the sale is a taxable supply for VAT purposes. The seller stipulates a payment period of 30 days from the approval of the purchase price by the creditors' committee and the insolvency administrator, payable to account number 2600240023/5800, variable symbol 25036114.
4. Interested parties must submit their bids via email to the broker's address, and simultaneously copy the seller's email address. Bids not copied to the seller will not be considered.
5. The subject of the sale is being sold and handed over "as is" (in aggregate) pursuant to § 1918 of the Civil Code, provided such sale is permissible under applicable law concerning the nature of the asset being liquidated, and the buyer must accept the items in their current state. This will be stated in the purchase contract.
6. The buyer is obliged to take possession of the subject of sale upon the seller’s instruction within the specified period. The risk of damage passes to the buyer on the date of handover; if the buyer delays in taking possession, the risk of damage transfers to the buyer once the period stipulated for handover expires. All costs related to taking possession are borne exclusively by the buyer.
7. The buyer has no right to specify any qualities of the subject of sale. The seller bears no liability for the condition of the item and does not guarantee that the buyer will be able to use the item for their intended purpose.
8. The seller does not provide any warranty regarding any characteristics of the item, and liability for defects is excluded (limited) to the fullest extent permitted by the laws of the Czech Republic.
9. The buyer waives in advance any rights due to defective performance, in particular the right to demand repair, replacement, price reduction, or to withdraw from the contract, all in accordance with § 1916 Para. 2 of the Civil Code.
10. The purchase contract will be signed only after the full purchase price has been paid.
